The Problem

Businesses large and small are leaving the state or closing their doors. California businesses face more taxation, regulation and litigation than any other state in the country. Whether large companies are being hammered with class action lawsuits or small businesses are threatened with litigation over alleged ADA violations, California’s legal climate is a markedly unfriendly one.

California continues to rank near the bottom of countless studies of business and legal climates. Additionally, 95 percent of respondents in a recent survey of California small business owners felt that the state’s laws favor those who sue.

Why it Matters

Other states with more business-friendly climates are actively recruiting California businesses and some have been successful. Frivolous and predatory lawsuits have closed down many small businesses. Both results are devastating to local communities and the entire state, resulting in higher unemployment rates and decreased tax revenue for local and state government.
